For the purpose of this agreement, A+ ComputerWorks and fixthispcnow.com are one and the same. When using any of our services, including but not limited to remote computer repair and telephone technical support, the following conditions apply: Service availability Our services are available anytime our chat box shows we are "online". If our chat box indicates that we our "offline," you can still contact us via E-mail and you will receive a response within 12 hours, usually much sooner. In the near future, we will have technicians available 24/7/365. If you have internet access or phone access, help is a moment away. Guarantee of services A+ ComputerWorks does not guarantee that it will be able to resolve every issue. Any services provided shall be in accordance with the limited warranty stated below. Our philosophy is to provide the highest quality service with 100% customer satisfaction. In almost every instance our customers' computer problems are resolved once service is complete. On the rare occasion where a customer's problem is not completely resolved, the customer may contact us within 7 days from the date of service. At that time we will attempt to resolve the issue to the satisfaction of the customer or issue a refund. A+ ComputerWorks has sole discretion in determining if a refund will be issued, and if it will be a full or partial refund. Right of refusal A+ ComputerWorks has the right to refuse service to any customer in its sole discretion without notice. Delay of services In the event A+ ComputerWorks delivery of services is delayed, prevented or made impracticable by catastrophic events such as fire, flood, earthquake, or other catastrophes, power outages, internet service outages, equipment failure, or any other issues that are beyond A+ ComputerWorks' reasonable control, A+ ComputerWorks shall not be held responsible for the delays by such cause. Lost or altered computer files Customer is responsible for backing up all files and proprietary and confidential information on the computer and for maintaining a procedure external to the hardware products for the reconstruction of lost or altered files, data or programs. A+ ComputerWorks shall not be liable for lost or altered files, data or programs, even if caused by the negligence of A+ ComputerWorks or it's agents or employees. Diagnostic and repair services are provided without any obligation of confidentiality or nondisclosure on the part of A+ ComputerWorks, it's employees or agents. Customer shall delete from the computer any file or data considered to be private, confidential or proprietary. Limitation of liability Except where such exclusion is contrary to public policy, in no event shall A+ ComputerWorks, its employees, agents or contractors, be liable under this agreement for any agreement for any indirect, special, exemplary, consequential, or incidental damages, including, but not limited to, loss of anticipated profits or revenue, economic loss, loss of data, loss of use of the product or any associated equipment, cost of capital, cost of substitute or replacement equipment, facilities or services, down time, customer time, the claims of third parties, and injury to property, regardless of the nature of the claim, including but not limited to, breach of warranty, breach of contract, tort (including negligence) or strict liability, and even if A+ ComputerWorks has been advised of the possibility of such loss or damage. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply. If any portion of this section is held invalid or unenforceable, any liability of A+ ComputerWorks and its suppliers and service providers under this agreement is expressly limited to the fees the customer has paid for the service giving rise to the claim. The customer's sole remedy against A+ ComputerWorks and its suppliers and service providers in any dispute under this agreement shall be to seek recovery of the amounts the customer has paid, upon the payment of which A+ ComputerWorks and its suppliers and service providers shall be released from and discharged of all further obligations and liability to the customer. Website use While A+ ComputerWorks uses reasonable efforts to include accurate and up-to-date information on the Site, A+ ComputerWorks makes no warranties or representations as to its accuracy. A+ ComputerWorks assumes no liability or responsibility for any errors or omissions in the content on the Site. Any communication or material you transmit to the Site by electronic mail or otherwise, including any data, questions, comments, suggestions, or the like is, and will be treated as, non-confidential and non-proprietary. Anything you transmit or post may be used by A+ ComputerWorks or its affiliates for any purpose, including but not limited to reproduction, disclosure, transmission, publication, broadcast, and posting.
